We host our site on a reputable platform and take reasonable efforts to maintain and host the site. However, we make no explicit representations or warranties as to the safety of your individual use of the website.

Use of such materials does not confer any rights of ownership or sublicensing to you or any third party.

You acknowledge that your participation in any in-person event, including those co-hosted or arranged in connection with our services, is voluntary and undertaken at your own risk. We disclaim all liability for any injury, loss, or damage incurred in connection with such events, except where required by law. 

Where an event, workshop, or training session is held at a venue arranged, owned, or controlled by a third party, responsibility for the safety, suitability, accessibility, and insurance coverage of that venue rests with the host organisation. We are not responsible for any loss, injury, or damage arising from the condition, safety, or operation of any third-party venue. 

From time to time, we may deliver workshops or training as a certified Chalmers Ambassador (The Chalmers Center for Economic Development) or TBRI® Practitioner (Karyn Purvis Institute of Child Development). In these instances, while contracts, delivery, and invoicing are managed by us, ownership and usage of any licensed materials is guided by the relevant licences and agreements in place with the applicable licencing bodies.  

NO WARRANTY   

All information, products, and services on this website are provided “as is” without warranties of any kind, express or implied. We do not guarantee uninterrupted access, freedom from defects, or that the site or server is free of viruses or harmful components.

LAW AND JURISDICTION  

These Terms, Conditions and Privacy Policy are governed by and construed in accordance with Australian law. Any dispute arising out of or related to the information contained herein is subject to adjudication in the state of Victoria, Australia.  

REFUNDS  

Due to the nature of our offerings, different refund terms apply to products and services: 

Digital Products and Online Courses: All digital products and online courses are non-refundable once purchased, due to the immediate access provided. 

In-Person Services (Training, Workshops, Consulting): Refunds are not generally provided for in-person services unless we fail to deliver the agreed services. If you wish to reschedule or cancel a booking, our cancellation and rescheduling policy (outlined in the Client Services Agreement or Proposal) will apply. 

Exceptional Circumstances: We may consider refund requests on a case-by-case basis at our sole discretion. Any agreed refunds will be confirmed by both parties in writing. 

Nothing in this clause is intended to limit your rights under Australian Consumer Law.  

ENTIRE AGREEMENT  

The information contained herein constitutes the entire agreement between site users and Tov Collective Pty Ltd relating to the use of this website.
